Probation, Parole and Penitentiary Law

The aim:
1. Upon completion of this course the student will have reliably demonstrated the ability to understand Polish penitentiary system, including: legal definitions, basic documents, admission process, security systems, work & education, prison service structure, types of units according to the security level, different categories of inmates, main rules of the execution of the imprisonment.
2. Moreover student will be able to identify probation and parole practices according to the polish penal law, knows facts and concepts of Electronic Monitoring System.
Student will be given the knowledge about Prisoners’ rights- according to the polish & international law. What is more student can name Relevant Legal Documents and its provisions.
3. Student will develop written skills and techniques for framing legal issues, presenting a compelling account of relevant facts, construct an answears that identifies legal issues in a concise written summary.

Acquired knowledge:
1. Student understands Polish Penitentiary System, knows Executive Penal Code and other basic documents and how or when to apply their regulations.
2. Student understands the concept and facts of Electronic Monitoring System. Student learns Prisoner’s rights concepts from a human rights perspective, according to the polish and international law. Student can name the most important prisoner’s rights including relevant legal documents.
3. Student understands the basic theories and practice of probation and parole. Understands the most important advantages of probation and parole, differences & relationship between those two institutions and the appropriate uses of each.

Acquired skills:
1. Student can name types of units according to the security level, different categories of inmates and identifies the main rules of the execution of the imprisonment. Student knows how work admission process and is able to describe work and education system in polish penitentiary units.
2. Student identifies Prisoners’ rights according to the Polish Executive Penal Code and international law documents. Student can name the most important rights and basic relevant documents.
3. Student knows how and when to use probation and parole institutions, can describe probation officers’ role, probation measures, probationer/ parolee responsibilities and consequences of breaking probation/parole rules.

Acquired social skills:
1. Through decision-making, legal writing student learn how to construct an answears that identifies legal issues in a concise written summary. Student develops written skills by case-solving.
2. Student can describe Electronic Monitoring System, advantages and disadvantages of this institution, types and general rules.
3. Student is able to reflect on prisoner’s rights issue from from a human rights perspective.

Course contents
1. Introduction into Polish Penitentiary System. This topic includes: legal definitions, regulations of Polish Executive Penal Code and other basic documents, prison service structure, types of units according to the security level, different categories of inmates and the main rules of the execution of the imprisonment.
2. Polish Penitentiary System, including: admission process, security systems, work and education.
3. Probation and Parole practices according to the polish penal system, including: the most important advantages of probation and parole, differences & relationship between those two institutions, consequences of breaking probation/parole rules and the appropriate uses of each institution.
4. Prisoners’ rights according to the Polish Executive Penal Code (the right to standard of living adequate for the health, the right to keep in touch with families, freedom of religion, the right to employment and the fair distribution of income, the right to education and self-education, the right to take part in cultural activities, education and sport activities, the right to communication with attorneys/probation officers and representatives, the right to make a request or submit a complaint).
5. Prisoners’ rights in International law including Relevant Legal Documents (Standard Minimum Rules for the Treatment of Prisoners, Universal Declaration of Human Rights & International Covenant on Civil and Political Rights, The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment & European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, Body of Principles).
6. Electronic Monitoring System including facts and concepts of this institution, short history of electronic monitoring, advantages and disadvantages of this system, types and definition according to the Polish Executive Penal Code.
7. Prison Population Trend in Poland. This topic includes actual statistics from primary data source in Poland- Central Board of Prison Service Statistics.
8. Probation around the world – origins and development.
