Complaints to the ECHR in Criminal Cases
The aim:
1. Providing knowledge on the procedure and rules of conduct before the European Court of Human Rights.
2. Providing knowledge on protection standards formulated by the European Court of Human Rights in criminal cases.
3. Providing knowledge on the practical aspects of submitting an individual complaint in criminal cases.
Acquired knowledge:
1. The student recognizes the importance of the proceedings before the European Court of Human Rights.
2. The student identifies the requirements for an effective submission of a complaint to the European Court of Human Rights.
3. The student is able to indicate the standards of protection formulated by the European Court of Human Rights.

1. The student is able to formulate a complaint to the European Court of Human Rights.
2. The student is able to apply the learned principles to solve the presented legal problem.
3. The student is able to critically analyze the jurisprudence of the European Court of Human Rights.

1. Student accepts the normative character of human rights and its effects.
2. The student independently formulates theses regarding a specific legal problem.
Course contents:
1. Legal nature of the Convention for the Protection of Human Rights and Fundamental Freedoms.
2. Structure and functioning of the European Court of Human Rights.
3. Formal rules for an individual complaint.
4. Substantive prerequisites for the admissibility of an individual application.
5. Protection standards for the right to a fair trial in criminal matters.
6. Prohibition of punishment without a criminal basis in the jurisprudence of the European Court of Human Rights.
7. Prohibition of inhuman or degrading punishment in the light of the jurisprudence of the European Court of Human Rights.
8. Prohibition of torture.
