Course contents
1. The TFEU rules relevant to public procurement and public-privatepartnerships.
2. Directive 2014/24/EU of the European Parliamentand of the Council of 26 February 2014 on public procurement:
a)subject-matter and scope;
b) definitions – contracting authorities,bodies governed by public law, public contracts, public works con-tracts, a work, public supply contracts, public service contracts, tenderers, candidates, procurement service providers, labels, label requirements;
c) thresholds;
d) general rules;
e) procedures;
f) techniques and instruments for electronic and aggregated procurement;
g) the conduct of the procedure;
h) the contract performance;
i)particular procurement regimes – selected examples;
j) governance– selected issues.
3. Directive 2014/23/EU of the European Parlia-ment and of the Council of 26 February 2014 on the award of concession contracts:
a) subject-matter and scope;
b) general principles;
c) definitions – concessions, economic operators, candidates,tenderers, concessionaires, execution of works, a work, an exclusiveright;
d) contracting authorities and contracting entities;
e) thresholds;
f) general provisions;
g) rules on the award of concessions –general principles and procedural guarantees;
h) performance ofconcessions.
4. The Green Paper on public-private partnerships andCommunity law on public contracts and concessions:
a) definition of public-private partnerships;
b) elements characterising public-private partnerships;
c) a selection of a private partner;
d) phases following the selection of the private partner;
e) institutionalised public-private partnerships.
