EU Criminal Law

The aim:
1. Bringing closer European standards in criminal justice.
2. Getting to know the basics of judicial cooperation in criminal matters in the EU.
3. Familiarization with the importance of the principle of mutual recognition of judgments in criminal cases.

Acquired knowledge:
1. Has knowledge of the basics of procedural and substantive criminal law of the European Union.
2. Has knowledge of EU and national bodies in counteracting crime, their structure and competences.

Acquired skills:
1. Understands and uses terminology related to EU criminal law.
2. Is able to interpret and properly apply EU criminal law regulations.

Acquired social skills:
1. Is prepared for active action (analysis, assessment, resolution) in justice and law enforcement agencies.
2. Able to work in a group.

Course contents
1. Introduction to EU law – institutions, sources of law, constitutional principles.
2. General outline of legal instruments in the judicial cooperation in criminal matters, legal effects of framework decisions and directives.
3. Bodies and agencies in the field of cooperation in criminal matters – The European Public Prosecutor’s Office, EUROPOL, EUROJUST, European Judicial Network.
4. Evolution of EU competences in the field of judicial cooperation in criminal matters.
5. Harmonisation of substantive criminal law in EU Member States.
6. Harmonisation of criminal procedure – rights of suspects, defendants and victims.
7. Principle of mutual recognition of judicial decisions: European Arrest Warrant, financial penalties, imposing custodial sentences or measures involving deprivation of liberty, European Evidence Warrant.
8. Ne bis in idem principle in EU law.
9. EU anti-terrorist sanctions.
